2.1 Information You Provide Directly to Us

We collect the Personally Identifiable Information you provide to us, when you register to become a Member, upload Content or engage in the Facilities.
2.1.1 Registration and Profile Information
In order to participate as a Member and to use the Facilities, we require that you complete the registration process and create a Member Profile. The registration process asks you to: (i) create a username, (ii) create a password, (iii) verify that you are at least 18 years old and provide a copy of your governmentissued identification, (iv) provide an email address, (v) provide your zip code, (vi) specify the country in which you reside, (vii) state your physical features such as: (a) height, (b) weight, and (c) age; and (viii) supply information about yourself and what you’re hoping to discover by being a Member of our App/Site. You also have the option to voluntarily list your COVID19 vaccination status on your Profile. TAPPNPLAY does not require you to disclose your vaccination status. We also give you the option of providing TAPPNPLAY with your full name, which helps us should you forget your password. Our system relies on usernames as the public App/Site “identifier” for the each Member. Subject to your Privacy Controls, Members’ username, gender, height, weight, Profile link, and Content are available to other Members and some Visitors.
2.1.2 Our Use of Profiles in Promotions
We believe that our Members’ own experiences on t
he App/Site can often act as the strongest promotion for the Site and our Facilities. To promote and illustrate the App/Site, therefore, we may wish to post on our homepage, and in other areas of the App/Site, Member Profiles, Content and other information that our Members provide to us. To this end, we provide “minisearches” in which Visitors performing searches will be able to see a synopsis of the Profiles of Members who have opted in to “mini searches,” and an image from such Members’ Profiles may be displayed on our homepage. Moreover, if you create an external profile, then Visitors will have greater access to your Content. You have the option of optingout of “minisearches” in your Profile settings. You may also request to become a “feature member” in which your Content may be prominently displayed on our homepage. Please be aware that all Visitors will be able to view your Content if you optin to participate in: (i) the minisearches, (ii) become a featured member; or (iii) activate an external profile.
2.1.3 Content

We collect the Content you upload to the
App/Site. All Content is reviewed by TAPPNPLAY for compliance with our Terms of Use and other guidelines prior to being made available on the App/Site. Your Content is available to Members and Visitors consistent with your Privacy Controls.
2.1.4 Billing Information

TAPPNPLAY
uses a thirdparty payment processor to handle electronic payments, and billing information shared with our vendor is intended to be used solely to allow said third party to process payments. Any personal information that we collect when processing payments made through “traditional” methods, such as check or money order, will be treated as Personally Identifiable Information.

2.2. MemberDirected Information
Member
Directed Information is information you intend to provide or make available to other users of our App/Site including, but not limited to, in our forums and chat rooms, as well as your shared Content and the information that you include on your Profile. If your MemberDirected Information includes any Personally Identifiable Information (such as your full name or a photograph of yourself), any such information can be collected and used by other Members and Visitors, and you may receive unsolicited communications or contact as a result. We provide a range of privacy choices to assist you in making good choices concerning the information you disclose. Please see Section 7 (Additional Tools for Protecting Your Privacy) for a description. Please note that all MemberDirected Information is also monitored by TAPPNPLAY.
2.2.1 Member Communications

By registering on the Website, Members indicate an interest in exchanging information with
other Members, subject to any Privacy Controls imposed. To allow such communications, we provide information to identify individual users, in the form of other Members’ username, gender, height, weight, and a link to their Member Profile.
2.2.2 Forums and
Chat Rooms
As part of our Facilities, we offer forums and chat rooms on our
App/Site. Only your username is available to other users of these Facilities. Any comments you contribute to the online dialogue, however, will be seen by all other participants immediately, and are attributed to your username. You
should, therefore, use discretion in what you submit to these exchanges. Additional guidelines for
the use of our forums and chat rooms are available on our App/Site.
2.2.3 Other Information Exchanges

he App/Site allows Members (i) to provide and receive information in a range of forms and on a variety of topics, and (ii) to engage in other activities through App/Site discussions that may include, at the option of the Member, an exchange of Personally Identifiable Information.
2.3 Usage Data

Certain information about your device and how you engage with the Facilities is automatically
collected when you access the App/Site (“Usage Data”). We collect Usage Data through features of the software that supports our Facilities, through cookies, and through other means described below. Usage Data that reasonably identifies you will be treated as Personally Identifiable Information and protected consistent with this Privacy Policy. Personally Identifiable Information that you make available on your Profile and your Content is
available to other Members and Visitor consistent with your Privacy Controls. We will otherwise not disclose your Personally Identifiable Information to unaffiliated third parties without your express consent, except in the following limited circumstances:

We may employ other companies to perform functions
on our behalf, such as maintaining the Website, processing payments, providing services related to the App/Site, collecting information, responding to and sending electronic mail, marketing/advertising, or other functions necessary to our business. We may need to share your Personally Identifiable Information with these companies (collectively, “App/Site Vendors”). If you sign up to become a Member through a referral link, the person who sent you the link will
know the level of Membership you have selected.

we believe that (i) you are at risk of harm from another, (ii) you are harming or interfering, will imminently harm or interfere, or have harmed or interfered with others, (iii) you have otherwise violated or will otherwise violate (either intentionally or unintentionally) our Terms, laws or regulations, or (iv) you are otherwise violating legal rights.
3.4. Legal Process
TAPPNPLAY
will reveal your Personally Identifiable Information to the extent we reasonably believe we are required to do so by law. If we receive legal process calling for the disclosure of your Personally Identifiable Information we may attempt to notify you via the email address you supplied during registration within a reasonable amount of time before we respond to the request, unless such notification is not permitted.
3.5 Advertisers

We may allow advertising companies or other third parties to display advertisements on our
App/Site. These companies may use tracking technologies to collect information about those who view, “click on” or otherwise access or interact with their advertisements in order to help them target and gauge the effectiveness of their advertisements. Once you engage with an advertisement on our App/Site, you may be taken to another website that is not governed by this Privacy Policy and is in no way under our control.
3.6 Transfer of Site

TAPPNPLAY

4.1. Privacy Controls

We provide you with privacy controls, that a
llow you to: (i) designate your Profile as “offline,” (ii) “block” certain Members; and (iii) designate certain uploaded Visual Content as “public,” “private,” or “personal” (collectively, our “Privacy Controls”). If you designate your Profile as “offline,” other Members are restricted from accessing your Profile. In addition, you have the ability to “block” specific Members. When uploading Visual Content on our App/Site, you can designate (and TAPPNPLAY will review and verify) each image as either “public,” “private,” or “personal.” All Members, and potentially App/Site Visitors, can view content marked “public,” and only those Members that you give permission to can view your uploaded content that is marked “private” or
“personal.” If you create an externa
l profile, then App/Site Visitors may be able to view additional content in your Profile. We have implemented specific guidelines (in our Help Menu) for the subject matter that can be depicted in the Content that you upload to the App/Site and all Content (regardless of public, private, or personal designation) is reviewed by TAPPNPLAY employees before it is available on the App/Site. TAPPNPLAY may additionally choose, but does not assume the obligation, to “spot check” Content for compliance with our Terms and guidelines. Please employ the Privacy Controls, and choose carefully the information you post on your Profile, and that you provide to other Members. You should take care if you choose to include information that personally identifies you, such as your telephone number, street address, last name, email address, and any photographs that could easily identify you or where you are located.
4.2 Reporting of Problems

If you feel that you or one of your friends have been harassed or bullied on our
App/Site, or that users have infringed upon your privacy or violated our Code of Conduct or other content guidelines, please contact us at tappnplay@gmail.com or report your concerns as set out in our Terms of Use.

Changing or Removing Information; Privacy Rights
5.1 Updating Your Information

To allow appropriate control over Personally Identifiable Information, you can access your account
(after supplying your username and password) to change or update MemberDirected Information and certain information that you have provided directly us.
5.2 Deleting Information

You can request we delete your Profile and remove your name and other Personally Identifiable
Information from our databases. Please understand that if you delete your Profile, all Visual Content will also be deleted and cannot be recovered, and you will be unable to utilize associated features of the App/Site or access the Facilities. Please note, however, that it may be impossible to completely remove all your information completely, due to backups and records of deletions. Additionally we will not remove deidentified, anonymous, or aggregate data from our databases. We may also retain certain personal information in order to comply with applicable laws, keep accurate records, resolve disputes, prevent fraud, enforce our Terms or other agreements, or for any other legally permissible purpose.
5.3 Privacy Rights in Certain Jurisdictions
Certain jurisdictions provide privacy rights to individuals with respect

I. Policy Statement
TAPPNPLAY, LLC (“TAPPNPLAY” or the “Company”) is committed to compliance with the Allow States and Victims to Fight Online Sex Trafficking Act (“FOSTA”) and other U.S. laws that may apply. This commitment extends to promoting strict compliance on an on-going basis with TAPPNPLAY’s Terms and Conditions.
II. Reason for Policy/Purpose
This FOSTA Compliance Policy (this “Policy”) sets forth the Company’s policies and procedures to be undertaken to further its compliance commitment. This document is a management system adopted to provide overall structure and controls for complying with FOSTA. The Company provides an online social network, the S TAPPNPLAY app/website (the “App/Site”) which allows users to connect with others who share similar interests. This social network allows users to create profiles, contribute to forums, and engage in group messaging. The Company will periodically review its compliance policies and procedures in the event of a material change in the Company’s business or applicable law.
I. Allow States and Victims to Fight Online Sex Trafficking Act (FOSTA)
FOSTA amends the Communications Act of 1934 and clarifies that the Communications Act does not prohibit the enforcement of Federal and State criminal and civil laws
relating to sexual exploitation of children or sex trafficking against providers and users of interactive computer services. Therefore, the Company will take the measures outlined in this Policy to deter users of the App/Site (the “User(s)”) from using the App/Site to engage in any activity that (i) promotes or facilitates prostitution, (ii) facilitates traffickers in advertising the sale of unlawful sex acts with sex trafficking victims, or (iii) may otherwise violate FOSTA.
III. Administration of this Policy
The Company’s Chief Compliance Officer (“CCO”) will oversee the administration of this Policy. The CCO will establish and oversee the management of procedures to facilitate timely detection of violations of FOSTA and coordinate the Company’s investigation of any reports of potential violations of FOSTA.
IV. Implement a Reporting System
The Company will set up an email account and identify a telephone number which the Users or any employees of the Company can email or call to report events that the User or employee believes to be a violation of FOSTA. If employees have questions regarding FOSTA or reporting of FOSTA violations, he or she may contact the CCO.
V. Audits & Investigations
The Company may audit the App/Site by reviewing the following: (i) the User’s profile, (ii) any of the User’s communications made on the App/Site, and (iii) other content transmitted on the App/Site by the User (an “Audit”). The Company may conduct an Audit for any reason, including if a User is reported per the reporting system discussed in Section IV of this Policy. The Company may also conduct an Audit for no reason, in its sole discretion. If the Company conducts an Audit which leads the Company to believe that any User has violated or may have violated FOSTA, the Company may terminate or suspend the User’s account or access to the App/Site. If the Company terminates or suspends a User’s account based on the belief that the User is violating or violated FOSTA and the Company later discovers that the User is not violating or did not violate FOSTA, the Company may reinstate the User’s access to the App/Site. The CCO shall make the ultimate decision regarding whether a violation of FOSTA is occurring or has occurred.
VI. Reports to Law
Enforcement
If the Company believes a violation of FOSTA is occurring or has occurred, it may report such violation to law enforcement.
